- To a dignified existence, self-determination and communication with and access to persons and services inside and outside the facility.
- To exercise his or her rights as a resident of this facility and as a citizen or resident of the United States.
- To be free of interference, coercion, discrimination, or reprisal from this facility in exercising his or their rights.
- To an appointed person under state law to act in his or her behalf when adjudged incompetent under the laws of the state by a court of competent jurisdiction.
- To be informed by this facility, both orally and in writing, in a language that he or she understands and in large print, if appropriate, of his or her rights and all rules and regulations governing resident conduct and responsibilities during his or her stay in this facility (such notification shall be made prior to or upon admission and during the resident's stay. Receipt of such information and any amendments to it shall be acknowledged in writing).
- To be fully informed, in a language that he or she can understand, of his or her total health status, including, but not limited to, his or her medical condition.
- To refuse treatment.
- To refuse to participate in experimental research.
- To be informed by this facility of all Medicaid benefits to which he or she is entitled, in writing, at the time of admission, or when the resident becomes eligible for Medicaid, and of all items and services that are included in this facility's services under the state plan for which the resident may be charged, and be informed when charges are made.
- To be informed by this facility, before, or at the time of admission, and periodically during stay, of services available in this facility and of charges for those services, including any changes not covered by Medicare of this facility's legal rights.
- To a written description of legal rights furnished by this facility which includes a description of the manner of protecting personal funds, a statement that the resident may file a complaint with the state survey and certification agency concerning resident abuse, neglect, misappropriation of resident property in this facility.
- To be informed by this facility of the name, specialty, and way of contacting the physician responsible for his or her care.
- To be notified of changes immediately and have notification given to physician legal representatives or interest family member within 24 hours when there is an accident resulting in an injury, a significant change in physical, mental or psychosocial status, a need to alter treatment significantly, a decision to transfer or discharge the resident, a change in room or roommate assignment, and a change in resident rights.
- To manage his or her financial affairs and not be required to deposit funds with this facility.
- To a system established and maintained by the facility that assures a full, complete, and separate accounting according to generally accepted accounting principles for resident's personal funds entrusted to the facility which precludes any co-mingling of resident funds with facility funds or with the funds of another person other than another resident and provides a financial record on request.
- To choose a personal physician.
- To be fully informed in advance about care and treatment and of treatment that may affect the resident's well being.
- To participate in planning care and treatment or changes in care and treatment unless adjudged incompetent or otherwise found to be incapacitated.
- To personal privacy and confidentiality of his or her personal and clinical records.
- To approve or refuse release of personal and clinical records to any individual outside this facility except when transferred to another health care institution or as required by law or third party contract.
- To voice grievances with respect to treatment or care that is or fails to be furnished without discrimination or reprisal.
- To prompt efforts by the facility to resolve grievances the resident may have including those with respect to the behavior of other residents.
- To examine the results of the most recent survey of this facility conducted by Federal or State surveyors and any plan of correction and readily accessible survey results posted in this facility.
- To receive information from agencies acting as client advocates and be afforded the opportunity to contact agencies.
- To refuse or perform services for this facility if he or she chooses when the facility has documented the need or desire for work in the plan of care which specifies the nature of the services performed and whether the services are voluntary or paid at or above the prevailing rate and the resident agrees to the arrangements described in the plan of care.
- To privacy in written communications including sending and receiving mail promptly and unopened, access to stationery, postage, and writing implements at resident's own expense.
- To immediate access to any representative of the Secretary of Health and Human Services, any representation of the state, attending physician, state long term care Ombudsman, the agency responsible for the protection and advocacy system for developmentally disable individuals or mentally ill individuals.
- To have this facility provide reasonable access by any entity or individual that provides health, social, legal, or other services to the resident, subject to the resident's right to deny or withdraw consent at anytime.
- To allow state Ombudsman examination of the resident's clinical record with resident's permission.
- To have regular access to the private use of a telephone.
- To retain and use personal possessions including some furnishings and appropriate clothing as space permits, unless to do so would infringe upon the rights or health and safety of other residents.
- To share a room with his or her spouse when living in the same facility and both spouses consent to the arrangement.
- To self-administer drugs unless the interdisciplinary team has determined that this practice is unsafe for a specific resident.
- To remain in this facility and not be transferred or discharged by this facility unless:
- The transfer or discharge is necessary for the resident's welfare and the resident's need cannot be met in this facility.
- The transfer or discharge is appropriate because the resident's health has improved sufficiently so the resident no longer needs services provided by this facility.
- The safety of individuals in this facility is endangered.
- The health of individuals in the facility would otherwise be endangered.
- The resident has failed, after reasonable and appropriate notice, to pay for a stay in this facility.
- The facility ceases to operate.
- To be given 30 days advance notice before transfer or discharge in cases other than an emergency.
- To be free from any physical restraint imposed for psychoactive drugs administered for the purposes of discipline or convenience and not required to treat the resident's medical symptoms.
- To be free from verbal, sexual, physical or mental abuse, corporal punishment and involuntary seclusion.
- To receive care and treatment in a manner and in an environment that promotes maintenance enhancement of each resident's quality of life, dignity and highest practicable mental, physical and psychosocial well being.
- To choose activities, schedules and health care consistent with the resident's interests, assessment and plan of care.
- To interact with members of the community both inside and outside the facility.
- To make choices about aspects of the resident's life in this facility that are significant to the resident.
- To organize and participate in resident and family groups in this facility.
- To participate in social, religious and community activities that do not interfere with the rights of other residents in this facility.
- To reside and receive services in this facility with reasonable accommodations of individual needs and preferences, except when the health or safety of the individual or other residents would be endangered.
- To inspect and purchase photocopies of all records pertaining to the resident upon written request and with 48 hours notice to the facility.
- To execute an Advance Directive which conveys to the resident's agent and physician(s) any wished concerning medical treatment:
- Living Will
- Appointment of a Health Care Agent
- Oral Directives
